STANDARD TERMS AND CONDITIONS*
We have tried to cover most situations that may arise, to make you
aware of our position, including the obligatory legalese. Should there be any
questions, feel free to give us a call. We've been in business for over 50 years
and expect at least another 50 years.
We will handle your account honorably, ethically and to the
best of our ability.
We will expect the same from you and that will benefit us both. We
want you to make money, that way, we may make some.
Terms are payment with order. We accept Master Card, Visa, check
or even cash. No C.O.D. orders accepted. Minimum order is $50.00*. All Shipments
shipped best way prepaid, normally UPS Surface. WE PAY DOMESTIC FREIGHT. Returned
check charge is $25.00. Export freight and insurance additional, F.O.B. Factory.
RETURNS: TALKIE TAPES® are shipped on an AS IS basis. All our
sayings have passed the test of time and are usable as shipped, but not all sayings
are usable in all applications. Claims must be made within 30 days from date of
shipment. Just tell us what's wrong.
If it's our fault we'll fix it, and quick, no charge, of course.
CALL FIRST *Returned material Authorization is required,
before return .
A restocking fee may be charged. Open packages of of tapes require verification
of all tapes in that package. Returns are very rare, less than 1/1000th of 1%
through 1996. CALL US FOR A Returned Material Authorization (RMA) NUMBER
BEFORE RETURNING ANYTHING. Shipping costs may not be refundable.
DESCRIPTIONS OF TYPES OF ORDERS AND SCHEDULES
STANDARD ORDER: A standard order is for stock tapes listed
in quantities of less than 20,000.
SPECIAL ORDERS: Any order for (1) a nonstandard saying or (2) any order
item for greater than 20,000 of a single saying are considered a special orders.
Special orders are generally not returnable.
CUSTOM TAPES: We also make up Special Custom Saying Masters
to order. Warning: See The Die Making Instruction sheet, before ordering.
The terms for CUSTOM SAYING MASTERS, CUSTOM TAPES AND SPECIAL ORDERS are non-refundable
(cash, check or money order only, no credit cards) payment with order.
Tapes Shipping Schedule: Standard STOCK shipped within 24 hrs. of
receipt of payment or as advised, Specials ship normally within 1 week and Custom
Tapes ship per schedule established at time of order.
Legal Disclaimer Stuff
LIMITED WARRANTY. Talking Devices Company (the "manufacturer") warrants
that TALKIE TAPES(TM) (the "tapes") will perform substantially in accordance
with the MANUFACTURER's claims for a period of 90 days from the date of receipt.
All warranties on the Talkie Tapes(TM) are limited to a period of 90 days from
the date of shipment.
REMEDIES. The MANUFACTURER's entire liability and your exclusive remedy shall
be, at the MANUFACTURER's option, either (a) return of the amount paid upon return
of product or (b) replacement of the tapes. This Limited Warranty is void if failure
of the tapes has resulted from accident, abuse, or misapplication. Any replacement
tapes will be warranted for the remainder of the original warranty period or 30
days, whichever is longer. THESE REMEDIES MAY NOT AVAILABLE OUTSIDE OF THE UNITED
STATES OF AMERICA.
NO OTHER WARRANTIES. The MANUFACTURER disclaims all warranties, either express
or implied, including but not limited to implied warranties of merchantability
and fitness for a particular purpose with respect to the tapes and the MANUFACTURER'S
documentation.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall the MANUFACTURER be
liable for any damages whatsoever (including, without limitation, damages for
loss of business profits, business interruption, or other pecuniary loss) arising
out of the use of or inability to use the tapes, even if the MANUFACTURER has
been advised of the possibility of such damages.
